These terms govern your use of kiharacosmetics.com and any purchase you make from it. Please read them before ordering. Nothing here takes away rights the law gives you as a consumer.

In these terms, “we” and “us” mean Kihara Cosmetics; “you” means the person using the site or placing an order.
Accepting these terms
By using this site or placing an order you accept these terms. If you do not accept them, please do not use the site.
We may update these terms — to reflect a change in the law, in our products, or in how the site works. The version published here is always the current one, and the date above tells you when it last changed. A change applies to orders placed after it is published; it does not change the terms of an order you have already placed.
Using this site
You may read, browse and share our pages, and use the site to buy products for your own use. Please do not:
- use the site unlawfully, or to harm, harass or defraud anyone;
- attempt to gain access to accounts, systems or data that are not yours;
- introduce malware, or interfere with the site’s operation or security;
- scrape or harvest content, images or customer information, whether by hand or automated means;
- resell our products commercially without our written agreement.
We may suspend or withdraw access if someone is doing these things.
Accounts
You can order as a guest or create an account. If you create one, keep your password confidential and tell us promptly if you think someone else has used it. You are responsible for activity under your account, except where it results from something we did wrong. Give us accurate details — we use them to deliver your order.
Our products
Our products are cosmetics: preparations for the care and appearance of skin, hair and nails. Product pages describe ingredients, directions and net weight as accurately as we can.
Because these are made from natural botanical materials, colour, scent and texture can vary slightly between batches. That is a normal characteristic of natural formulation and not a defect. Screens also render colour differently, so a product may not look exactly as it does on your display.
Safety — please read this part
Natural does not mean that no one can react to it. Essential oils and botanical extracts are active materials.
- Patch test before first use. Apply a small amount to the inside of the forearm and leave it for 24 hours.
- Read the ingredients if you have known allergies or sensitivities.
- Stop using the product if irritation, redness or discomfort develops, and seek medical advice if it persists.
- For external use only. Keep away from the eyes and out of reach of children.
- If you are pregnant or breastfeeding, or have a diagnosed skin condition, speak to a doctor or pharmacist before use — some essential oils are not recommended in these circumstances.
Information on this site, including anything suggested by the product concierge and anything published in our journal, is general information about cosmetics, not medical advice. It is not a diagnosis and is not a substitute for a qualified healthcare professional. If you have a medical concern, please consult one.
Orders
Placing an order is an offer to buy. A contract is formed when we send you an email confirming the order has been accepted and dispatched — not when you receive an automatic acknowledgement that we have received it.
We may decline an order where the item is out of stock, where there has been a pricing or description error, where we cannot obtain payment authorisation, or where we suspect fraud. If we decline an order you have paid for, we refund it in full.
Price and payment
Prices are shown on the product page and include any taxes stated at checkout. Delivery is charged separately and shown before you commit to the order.
We take payment through PayPal; your card details are handled by PayPal and are not stored by us. If a product’s price was wrong and you have already ordered, we will contact you before proceeding — we will not simply charge the higher amount.
If you are ordering from outside Jamaica, import duties or local taxes may be charged on arrival by your own authorities. Those are not within our control and are your responsibility.
Delivery
Delivery options and costs are shown at checkout. International orders are normally delivered within two to three weeks. That is an estimate rather than a guaranteed date: customs clearance and delays in the postal or courier network are outside our control.
Risk in the goods passes to you on delivery. If your order arrives damaged, tell us as soon as you reasonably can so we can put it right.
Returns, cancellation and refunds
Our full policy is set out in the Refund and Returns Policy, which forms part of these terms. In summary:
- Refunds are given where an order you paid for is not delivered.
- Returns are accepted where we sent you the wrong product.
- Store credit may be offered in other circumstances, considered case by case.
Cosmetics are subject to hygiene and safety constraints: once a product has been opened or used it cannot be resold, so we do not accept returns simply because you changed your mind. None of this affects your legal rights if a product is faulty, damaged or not as described. If something arrives damaged or is not what you ordered, contact us and we will put it right.
Reviews and anything else you post
If you leave a review or comment, it must be your own honest opinion, and it must not be unlawful, misleading, offensive, or someone else’s material used without permission. Please do not post other people’s personal information.
You keep ownership of what you write. You give us permission to display it on this site and to quote it in our marketing, alongside the name you posted under. If you ask us to remove your review, we will.
We may decline to publish, or remove, material that breaches these terms. We do not check everything that is posted, and a published review is the view of its author rather than ours.
Our content
The text, photographs, product formulations, brand names, logos and design of this site belong to Kihara Cosmetics or are used with permission, and are protected by copyright and trade mark law.
You may view and print pages for your own personal use, and share links to them. You may not copy, republish, sell or use our content or brand commercially without our written permission.
Links to other sites
Where we link to another site, it is for convenience or reference. We do not control those sites and are not responsible for their content, products or privacy practices.
Availability of the site
We work to keep the site available and accurate, but we do not promise that it will be uninterrupted or error-free. We may change, suspend or withdraw parts of it, including individual products, without notice.
Our responsibility to you
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses such as lost profit, lost business or lost opportunity, since our products are supplied for personal use.
We do not exclude or limit our responsibility for death or personal injury caused by our negligence, for fraud, for defective products, or for anything else that cannot lawfully be excluded. Nothing in these terms affects your statutory rights as a consumer.
Where we are responsible, and the law permits a limit, our liability in connection with an order is limited to the amount you paid for it.

General
If any part of these terms turns out to be unenforceable, the rest continues to apply. If we do not enforce a term straight away, we have not given up the right to do so later. You may not transfer your rights under these terms to someone else without our agreement.
These terms and any dispute arising from them are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws in your own country.
